Cooley of the Penn Square Partners this morning at .This is a full scale and vicious attack on Commissioners Shellenberger and Henderson. The underlined links in his email may not "work." I will provide his links later today or tomorrow. There will be much more on this situation tomorrow.]
At their meeting yesterday, former County Commissioner, Paul Thibault, told Lancaster County Commissioners Shellenberger and Henderson, that it looks like they have started to work on Conestoga View again.
After wasting $210,000 of local taxpayers' money in legal fees to stop the downtown hotel and convention center project, they now have committed another $75,000 - and a blank check payable to the County's law firm - to another transparent attempt to delay or cripple this vital economic development project. It's a shame that their back room business deals are not equally transparent. In the coming days, you will hear and read that Penn Square Partners and many other local leaders have simply refused to cooperate in any way with the feasibility study that the two Commissioners have engaged PKF Consulting to do. We want you to know why we're not participating:
The process smacks of a pre-ordained conclusion. Why else would these two Commissioners have awarded the contract to the only bidder on February 15 - seven days before the close of the proposal submission period and nearly two weeks before the date on which the contract was to have been awarded? With Commissioners Shellenberger's and Henderson's record of negotiating contracts, why would they have broken their own rules?
The consulting firm has conflicts of interest. Though PKF Consulting clearly stated its conflicts of interest in its response to the Commissioners' RFP, the two Commissioners awarded the contract to the same firm that served as an expert witness for hotel litigants who tried to stop the project. PKF also has served as a consultant to the Eden Resort, a key litigant. The two Commissioners have not made public the written statement required by PKF's contract acknowledging these conflicts. This study is an egregious waste of taxpayers' money and another example of the two Commissioners' demonstrated fiscal irresponsibility.
The two Commissioners have accepted $65,000 in private funding for a public document. The "concerned citizen" making the donation has a vested interest in the outcome of the study. He is a hotelier and an aggressive opponent of the project. He already has commissioned a "poll" about this project that has been exposed by credible experts as being severely flawed and misleading. This is an unacceptable breach of the public trust.
The two Commissioners' RFP was so transparently designed to elicit a study that would unravel the project that the consulting firm had to tell them so! The two Commissioners asked for a two-phase study. The first phase would, among other similar tasks, review "the contracts between the various project team members, their appropriateness and additional considerations, corrections and modifications that should be incorporated to clarify the responsibilities of the various parties." In other words, the two Commissioner's first aim is to question and un-do the contracts that already have been executed between the private sector, the Lancaster County Convention Center Authority, the Redevelopment Authority of the City of Lancaster and Lancaster City Council - all legally authorized government entities. PKF told them that they should study the marketplace first. In our view, these two Commissioners, who live in a glass nursing home, shouldn't throw studies.
This is the wrong action at the wrong time by the wrong people. Feasibility studies are done at the beginning of projects, not after construction is underway. Although the two Commissioners have claimed repeatedly that their late-term feasibility study is necessary because a feasibility study never has been conducted for the project, the study they just commissioned will contain exactly the same scope of work as the November 2000 PricewaterhouseCoopers feasibility study. If it looks like a feasibility study, acts like a feasibility study and talks like a feasibility study, it is a feasibility study.
The two Commissioners have given the County's lawyers a blank check. PFK's contract reads: "Any legal expenses incurred in defending or representing ourselves concerning this assignment will be the responsibility of the client." Do you believe that this charade will go unchallenged? The two Commissioners are the only ones wasting county money on this project.
This waste of your money seems even more outrageous when you consider the flood of evidence that the hospitality industry, including the group-meeting segment, is stronger than ever.
Commissioners Shellenberger and Henderson have demonstrated time and time again that they are not listening or following good business practices. But they must hear that this action is unacceptable to our community. If you are asked to participate with this study, please consider the result to which you would be contributing and consider refusing to contribute to this illegitimate effort.

I should have said I agreed with everything in the email except for this, “As you well know, ultra-conservative LancasterCounty for the most part believes gay marriage is morally wrong, maybe even more so than gambling.”
I don’t believe that is true.I think the Lancaster Newspapers, in the ultimate hypocrisy, keep telling us that.Why is Lancaster so “ultra-conservative?”Why is one county the bastion of conservatism in the whole state?Because of the Lancaster Newspapers.That’s why.
BOYD’S AN IDIOT
They wrote article after article on Representative Scott Boyd’s incredibly stupid “Marriage Protection Act.”On February 3, Jane Holahan of the New Era wrote, “’Brokeback’ goes mainstream.”Her opening sentence?“How can a movie about two men falling in love with each other become a success in a conservative bastion like LancasterCounty?”Then Holahan desperately goes looking for people to knock the movie and she doesn’t find any.It’s a really stupid, pointless article.
Her third and fourth sentences tell the whole story, “’It’s been doing well here,’ says Mitchell Cole, a manager at the Regal Cinemas.‘There does seem to be a pretty good mix of people in the audience.’”End of story.What happened to “conservative” Lancaster?

One day later, Janet Kelley of the New Era, “profiles” Boyd in their Saturday “Newsmaker” feature with a story titled, “’An impact on our society.’” She has the following question and answer with Boyd, “Why does he support the one-man-one-woman definition of marriage?‘I believe there’s no truth that’s more self-evident,’ Boyd said.”
Boyd’s an idiot.Then Boyd says, “My harshest critics have come from the southeast part of the state, around Philadelphia,’ he said.”Hmmm.Blame it on those crazy liberal Philadelphians.And of course, David Kirk lives in Phoenixville!

Timothy L. Callahan, the Democrat running for State Representative in the 97th District against incumbent Roy Baldwin, states the following in a press release yesterday:
“Thrice divorced radio commentator Rush Limbaugh rants and raves about family values and himself determines who is a ‘real American.’‘Book of Virtues’ author Bill Bennet tells the rest of us how to live while hiding his own multi-million dollar gambling addiction.
“In Harrisburg legislators of both parties participate in the illegal pay grab.We see that legislators have not seen fit to raise the State’s minimum wage from $5.15 an hour in 9 years.We see that Lancaster County Republican legislators latch on to hot button issues like the Marriage Protection Act that would deny the most basic civil rights (medical decision making and inheritance rights) to people who find their life partners among people of their own gender.”

I’m also beginning to really enjoy Larry Alexander’s Intell columns.This morning he writes, “Warning:Not everything in this column is a fact.”There are several enjoyable moments but my favorite is this:

The handful of Talkbackers who support the Convention Center suddenly have become the biggest defenders of the “gay lifestyle.” This was posted today in huge print, “Attacking someone for being gay is stupid.It really shows lack of intelligence.”We aren’t attacking anyone for being gay.The Lancaster Newspapers do that.We’re just pointing out their total hypocrisy.Please see the two New Era articles mentioned above.And Mr. Kirk’s websites are not “mainstream” by any means.Ask your gay friends.
