“ILLEGAL STATEMENT”

“Newspaper's stake in project surprises foes,” today’s New Era (click here).

“Penn Square Limited, which is owned by Lancaster Newspapers, owns 44 percent.”

“John M. Buckwalter, chairman of Steinman Enterprises, which owns Lancaster Newspapers Inc., said the makeup of Penn Square Partners was not released sooner because ‘at that time Penn Square Partners did not feel that that was relevant.’”
“He added that any insinuation that the developers were seeking a gag order is wrong.”
“'The only thing that is being asked for is that (the commissioners) are not allowed to say they’re going to take an illegal action,’ Buckwalter said."
“'The First Amendment does not cover somebody who’s going to make an illegal statement that is designed to harm a project,' he added.”

~ In this Century ~

NEWS BLACKOUT

THANK YOU DICK AND MOLLY

“‘Commissioners Shellenberger and Henderson are fighting for county taxpayers.  They’ve done so at considerable personal risk and political risk, and they’re not daunted.  They will keep fighting for county taxpayers.’”

Lancaster County attorney Howard Kelin in his closing argument yesterday, WGAL, (click here).

GAG ORDER

"The biggest irony that's going on here is we have the newspapers, who should be defending the First Amendment, seeking a gag order so that elected public officials cannot do the public's business."

Commissioner Molly Henderson quoted in today’s Intell article, “City project’s lawsuits weave a tangled web.”  The article was not posted online.

WHO CARES WHAT THEY “WANT?”

“Given that financing for the $140 million project is not totally in place and that the commissioners likely would appeal a preliminary injunction if one is issued, Madenspacher asked the developers' attorneys: ‘Why is my decision going to solve all the problems of the world?’”

Quoted from today’s Intell article, “Project backers want quick ruling.”  The article was not posted online.

ALLOWED?

“Do you think commissioners should be allowed to change the public portion of the financing for the convention center project.”

The WGAL “poll” that is currently being conducted (click here).

What kind of stupid question is that?  Seriously.  Why wouldn’t the commissioners be “allowed” to change the public portion.  Isn’t that their job?  Isn’t that why we elected them?

What a stupid and biased poll by the station whose manager signed the PSP’s ridiculous letter as a “community leader” supporting the center and demanding the commissioners stop trying to “kill” it.

BLACKOUT

Please note that I can not link to the above Intell articles as they are not posted online.  For three days now, the articles dealing with the hearing have not been posted.

This is a news blackout and a blatant attempt by the Lancaster Newspapers to: 1) squelch public comment; 2) prevent news sources from linking to them; and 3) to try and keep this as secret as possible so that word doesn’t get out that a newspaper has sued to put a “gag order” on elected officials to protect their own publicly funded white elephant.

Unbelievable.  I can’t wait until the press gets wind of this.

ABSOLUTELY APPALLING

Because it is so important, I am once again going to reprint this statement posted by a Talkbacker:

“I just want to say that the attempt to silence political speech, especially that of an office holder, is absolutely appalling. Period. This is one of those moments in time that you want to remember so you can tell your grandkids that, yeah, I remember when they actually tried that in Lancaster's courts. No, not in the last century, in THIS century.”

*** BREAKING NEWS ***

For people who are desperate to chat and make sure others are alive, don’t forget www.reportertalk.com - and a Talkbacker started this forum - http://www.vf11.com/lancaster .  Hey, I’m not “banned” in either one of these!  Oh, happy day!

While you have nothing to read (sob!)  – click here to go to WGAL and vote in their poll on this question – “Do you think commissioners should be allowed to change the public portion of the financing for the convention center project?”  (I personally feel the commissioners were voted into office to do nothing – but that’s just my opinion!)

The Lancaster Online website has been “down” for hours.  I placed a call to the New Era news desk this morning at 7:15 a.m.  The very nice man who answered said they are aware of it – there is a glitch and it’s being worked on.  He said he didn’t know how quickly it would be back up.  Please stay tuned…

YIKES!  IT’S A NEWS BLACKOUT!

PLEASE CHECK BACK LATER…

                             ~ Super Jerks! ~

“HUSBAND CHECKS

HER HOMEWORK”

FACTS OF LIFE

I have never read such a condescending, offensive, stupid and misleading headline in my life.  Never.  How did this headline make the front page of a Sunday Newspaper in the year 2006?  The article was not posted online (I wonder why!) so I cannot link to it.

The story is about Commissioner Molly Henderson’s testimony on Friday in the lawsuit by the PSP/LCCCA against the Commissioners.  The article states this:

“Many times, Fenningham phrased his questions about the resolutions with ‘drafted with your husband’s assistance.’”

“Kelin, who is representing the county and the commissioners, eventually objected.  Madenspacher [presiding Judge Joseph C. Madenspacher] upheld the objection saying, ‘It is a fact of life’ that a spouse would offer input on such a matter.  He told Fenningham to not insinuate that Henderson did something wrong.”

End of story.  There is no story other than Fenningham tried to take a cheap shot at a woman.  And the Sunday News took an incredibly sexist and cheap shot with this headline.

NOT SMART

Marvelous Marv, the editor, should definitely have someone check his and Gil Smart’s work.  Please see the “Breaking News” box directly below this story.  I am against the war as much as anyone – but Smart lies.  It is not acceptable.  I no longer believe a single word Smart says, and if the Sunday News continues to let this man lie unchecked, I will not believe a single word that appears in that paper - and I don’t believe many of them as it is!

WREAK HAVOC?

And Marv tells a “cute” story about his birthday in his column this Sunday, “Hey, that’s not funny!” and the numbers on his cake being reversed and reflecting retirement age.  He says:

“Note to county commissioners, who have 536 more days in office to wreak havoc:  Don’t get your hopes up.  I’m 56.”

Marv, I bet they are just shaking in their shoes - and, hey, that really is not funny!  More like pathetic.

And, of course, Marv has to make a “funny” comment about women and his daughter’s “Aunt Peggy.”  He says of her, “(age withheld to protect me).”  Hmmm.  Marv, my age is 52 and on top of my already cranky nature and the hot weather, I’m having hot flashes.  You don’t want to annoy me, Marv.  Trust me.

MODUS OPERANDI

Speaking of being annoyed, I am going to come back once and for all (hopefully) to the men’s rights nutjob later this week - but this quick update/warning.  This poster is a person who is desperate for attention and has a slew of screen names.  So, be on guard and remember this person’s modus operandi:  desperate for attention and an argument, claims to have lived in Lancaster at some point, always claims the other side has no “facts,” just “opinions,” dislikes attorneys, resorts quickly to personal insults but loudly screams foul if anyone dares question her motives, and finally, this person often misspells “a lot” as “alot.”  Ding.  Ding.  Ding.

SUPER JERK?

And thinking about the men’s rights nutjob reminds me of:

“Benevolent Dictator?  Hmmmmm.  Has a little ring to it.  LOL Dictator?  Naw!  I'll just stick with Boss. But, you can also refer to me as the ‘Super Jerk’ if you prefer.”

The "LOL Boss" posting on Talkback yesterday.

Oh, heavens!  I would never think of calling you a “super jerk.”  Who would do such a thing?  I am, however, still waiting for my T-shirt, LOL Boss.  Could you check on that for me?  Remember – pink, short-sleeves and size medium?  I’ve been waiting a long time.  Did I mention my cranky nature and hot flashes?   Thank you so much.

HEAD COUNT - Days until the end of Marvelous Marv: 536.  Marv should have his wife check his homework (and Smarts)!  The closing arguments in the suit against the Commissioners are today at 10:30 a.m. in Courtroom 2 at the Lancaster County Court House.  Please check back later today…

*** BREAKING NEWS***

SMART LIES, AGAIN…

A sharp reader caught Gil Smart “chopping” a quote and taking it out of context.  Smart opens his column this week with this:

“One international official told me of reports among his staff that a 15-year-old girl had been beheaded and a dog’s head sewn on her body in its place; and of a young child who had had his hands drilled and bolted together before being killed.”

This is the transcript of what was reported from CNN (click here).
“Once a confluence of cultures, Baghdad is turning into sectarian islands of fear. (on camera): In an indication of just how bad fears have become, one international official told me of reports among his staff that a 15-year-old girl had been beheaded and a dog's head sewn on her body in its place; and of a young child who had had his hands drilled and bolted together before being killed. Whether or not the reports are accurate, the staff took them as fact. It seems in this climate of fear, no act is so barbaric it can't be believed.
Nic Robertson, CNN, Baghdad.”

The war is bad enough.  Smart needs to be called on the carpet.  He has done this once too often.  Please check back on Monday…

~ Don’t Waste Artie’s Taxes! ~

 WANTED –

FOR CRIMES

 AGAINST TAXPAYERS

What a week!  The Lancaster Newspapers and WGAL made fools of themselves.  The PSP/LCCCA made a terrible judgment call by filing a lawsuit.  Jeff Hawkes killed his career.  Big stuff went on in York and thankfully there were some terrible headlines.

WANTED

First things first - fun, of course.   Artie See has a biting satire on City Council President Julianne Dickson on Looking At Lancaster titled,  “WANTED: For Crimes Against Taxpayers,” (click here).  Wow!  Don’t make Artie mad!

CRYING FOWL

Happily, there were some God-awful headlines this week.  Steve Brody wrote the New Era column:

“Wabid about wabbits:  Gardener’s wecipe for insanity.”

This man needs to spend some time in an asylum.

There was this dreadful pun from the Intell:

“How to get a tree to leave.”

The Intell also got really hung up on the word “fowl,” running the following three headlines in two days:

“Fowl-free Long’s Park”

“Park patrons want fowl to stay, despite the droppings”

“Mayor:  Don’t feed the fowl”

Take you own advice, Mayor Gray.

The New Era ran the longest headline and after reading it, you have to wonder why you even need a story – the headline tells it all except one thing:

“Hot, sticky and getting worse – it’s perfect weather if you’re corn.”

Yes, but how many of us are corn?  The mayor maybe - and fowl like corn but we can’t feed the fowl.  I’m confused.

But it was the Intell with the absolutely “best” headlines.  You have to wonder what this editor was smoking.  Talkbackers, of course, jumped on them and for fear of U.S. Rep. Joe (he’s the pits) Pitts coming after me, I can only print them and simply cannot comment.  I think you’ll see why:

“Blue Ball pair sent to prison”

“Man breaks leg at Suzy’s Hole”

Mr. Pitts, I did not write them.  I am simply reprinting them.  Thank you.

PERSONAL GAIN

“In her original and amended complaints, Downing sought to peel back a layer in one of the county's most powerful, agencies. Court filings that followed, including depositions of detectives, assistant district attorneys, and even Rebert himself, gave the public a rare look inside the district attorney's office.

Downing's filings portrayed the office as one rife with cronyism, political malfeasance and bending of the law for personal preference or gain.”

This is from the York Daily Record and a lawsuit against the District Attoney’s Office that was settled this week, (click here).

Hmmm.  You don’t suppose the Lancaster DA’s office is rife with cronyism, political malfeasance and bending of the law, do you?  There will be more on this at a later time.

HAWKEYE HAWKES

    “Uncertainty.  Fear.  Delay.

These are the cards the two commissioners play to perfection.”

Jeff Hawkes, Intell, “Verdict, it seems, already is in for downtown project,” 7-14-06

Hawkes’ career is over.  He is wishy-washy, a back stabber and a lousy writer.   He also said this:

“Dreams of an upscale Marriott hotel on Penn Square and an adjoining center teeming with visitors will remain just that:  fantasy.”

“Teeming,” Hawkes?  Read this, Hawkes – “Soon Every Town in America Will Have an Unused Convention Center,” (click here).

I linked to this article yesterday, but if you haven’t read it, please do.  Common sense must prevail.  It is years past the time when the PSP/LCCCA should have pulled the plug on this white elephant.   It is a fantasy, Hawkes.

CONFLICT OF INTEREST

Regarding the convention center and this week’s court hearing and WGAL’s “Investigative Reporting” on the county Commissioners, this was posted on the WGAL forum:

“The Hotel/Convention Center is a very political and personal venture which only has a benefit to serve a few for financial gain.  It seems that of all the politicians, Molly and Dick are the only ones who have concern over what will happen to the private individuals living in our county. If Pete Shaub, Gib Armstrong, Mike Sturla, Tom Smithgall, Dave Hixson, Dale High, Rufus Fulton, John Buckwalter, the Steinmans, WGAL (Hearst-Argyle) want to pay for it... let them.  I realize the players listed aren't all technically involved, but the obvious conflict of interest by some and the spin by the media are, I thought, obvious.”

Yes, indeed. The conflict and the spin are obvious.  There will be much more on all of this on Monday, when closing arguments in the PSP/LCCCA lawsuit against the County Commissioners will be given in Courtroom 2 at 10:30 a.m.

Have a nice weekend.  I only reprinted them, Mr. Pitts!

“WHAT A WEEK!” IS COMING LATER TODAY…

This site was “down” briefly this morning.  The problem was with the webhost not this site.  Everything now appears to be fine.  Please check back later.

A very bright Talkbacker just posted a link to the above article (click here).   It is excellent.  Go-karts, anyone?  Please check back tomorrow.

*** BREAKING NEWS ***

7-14-06 - 1: 45 p.m.

The hearing between the County Commissioners and the PSP/LCCCA is still going on in Judge Madenspacher’s courtroom.  It may or may not wrap up today.

~ Shame on You ~

HAWKES IS TOAST

(I wrote this yesterday about Jeff Hawkes’ Intell column, “In the end, city project rewards outweigh risks,” but didn’t use it.   I am publishing it now because Hawkes has seen fit to write a completely contradictory and vicious column today titled, “Verdict, it seems, already is in for downtown project.”  The hotel/convention center is dead, Hawkes, and you’re toast.)

In the middle of a court battle and a new lawsuit by hotel owners challenging the hotel tax, Jeff Hawkes writes another column backing his employer’s publicly funded hotel and convention center.

     Hawkes begins:

“In a recent column I explained why I think the revitalization potential of the convention center project outweighs the financial risks.”

No, you didn’t, Hawkes.  Lanco Yokel took you to task with "You Don't Have to be an Expert, Jeff.  But How About Some Logic?" (click here) and I published "Descent into Madness" (click here).

Then Hawkes has the unmitigated gall to say this about a Plan B:

“But the advantage of the existing project is groundbreaking could happen soon.”

What world do you live in, Hawkes?  That’s a lie and you know it.  Let me repeat, there is a court battle going on, a new lawsuit by hotel owners, a request by Common Cause for the governor to investigate the LCCCA and there is no current funding for the project.

I’m not even going to discuss his new math calculations this week.   His final sentence is this:

“They [“city leaders”] understand that a lot has to go wrong before any taxpayer is out a dime.”

The LCCCA has spent $18,000,000 in eight years and they have a six inch paper file and a hole in the ground to show for it, Hawkes.   Lanco Yokel says you get an "F" (click here) and I say shame on you.  You're toast.

HAWKES SAYS IT’S DEAD!

(It must be true!  Check back later today…)

     ABSOLUTELY

"Freedom of Speech" - Norman Rockwell

APPALLING

“I just want to say that the attempt to silence political speech, especially that of an office holder, is absolutely appalling. Period. This is one of those moments in time that you want to remember so you can tell your grandkids that, yeah, I remember when they actually tried that in Lancaster's courts. No, not in the last century, in THIS century.”

The above was posted under this morning’s Intell article, “Battle over city project moves to courtroom.”

It is completely appalling and what makes it absolutely unbelievable and scary is that it is a newspaper that is trying to stop free speech.  And the newspaper is breaking every journalistic code of ethics by acting as a non-stop propaganda machine for its own, publicly funded, hotel/convention center project (please see the “Breaking News” below).

The Lancaster Newspapers have also taken down their article linking tool so that I cannot link directly to articles and the Talkback that is below them.

I am rarely speechless.  I am rarely this appalled and scared.

Please check back tomorrow when the case resumes in Courtroom 2 at 9:00 a.m. with Judge Joseph C. Madenspacher presiding.

IN YOUR DREAMS…

“Representatives of the developers -- the Lancaster County Convention Center Authority, the city Redevelopment Authority and Penn Square Partners -- revealed that the concrete foundation for the center will be start(sic) before Aug. 1, regardless of the outcome of their suit against the commissioners.”

The above was just posted online at 10:27 a.m. as a New Era article titled, “Center’s foundation pouring to begin by Aug. 1,” (I cannot link to it at this time – please check back later).

No it will not.  Who do you think you are?  Who do you think you are?

Hawkes, you were told not to do math!  The LCCCA cancels their meeting and I am responsible for the men’s rights nutjob?  WOW!   Check back later today...

HOTEL OWNERS FILE SUIT

PRESS RELEASE
July 12, 2006

Contact: Kathryn L. Simpson, Esquire
 Mette, Evans & Woodside
 3401 North Front Street
 Harrisburg, PA 17110
 717.232.5000

Horst Hotel Co. and Ephrata Motel Partners, LP, announced that they have filed suit against the County of Lancaster challenging the constitutionality of the 3.9% hotel tax which was enacted in 2000.
The suit asks the Lancaster County Court of Common Pleas to declare that the hotel tax is unconstitutional because its burdens outweigh any benefits to the plaintiffs. Necessary parties, those who would be affected by such a declaration, are the Redevelopment Authority of the City of
Lancaster
, the Lancaster County Convention Center Authority, and Penn Square Partners.
The two plaintiffs were not part of the prior suit which challenged the hotel tax in 2000. The new action is based on, among other facts, a recent study done for the
County of Lancaster
by PKF Consulting.

ABUSIVE BEHAVIOR

“Kim Myers and two witnesses told police that Myers hit her during an argument after midnight on June 23 near Fenway Park in Boston. Police responding to a 911 call found Kim Myers crying and her face swollen. Myers pleaded not guilty to assault charges and has an Aug. 4 court date.”

Montgomery says Giles got it wrong - The Phils' president said the chairman misjudged his explanation of Brett Myers' arrest last month,” today’s Philadelphia Inquirer (click here).

GET LOST

“Researcher calls for women to stop abusing men.”

This, honest to goodness, was a thread topic started on the Talkback board by the men’s rights nutjob, who says she’s not a men’s rights nutjob, just worried about the children.  This, of course, is the poster who is getting on my nerves worse than a tick in a dog’s ear.   I hate liars.

Today, she links to this men’s rights’ site and “Stories of Abused Men in Tennessee.”   These people are so stupid they post the story, “Coffee County wife shoots and kills husband.”  The woman killed him in self-defense because he was going to kill her and their three children.

    The story says:

Coffee County authorities say Foster physically assaulted his wife in front of their three children — ages 6, 5 and 3 — then threatened to kill them with a .38 caliber handgun.”

And look at the dates on these stories!  This is sick.  I will have more on this lying nutjob shortly.  Get lost.

CLEAR ON THIS

Ron Harper is a close second in being on my nerves and posted this two nights ago:

“Becky promised me that she was going to post what names she has sneaked onto this board but I haven't seen it yet.”

Calm down, Harper, it’s coming.  I will tell you the last time I had an excellent time as I chased the above nutjob around and she screamed:

“Are you admitting to stalking me?  I’d like to be clear on this.”

What a hoot!  I had to post the Lancaster Police phone number for the poor dear.  There will be much more and an answer to your question, Harper.  Calm down.

INCONTINENT

For fun, and because I admit to loving gossip, and the Cruise/Holmes coupling is just the best, I thought I would post the lastest gossip flying around the globe - did they have a child?

“Almost three months after the birth of Tom Cruise and Katie Holmes’ daughter, the Shroud of Suri has yet to be lifted.   Suri Cruise has yet to be seen in public, either in person or photographically, since entering the world April 18.

To some, this is a holdout of staggering proportions.

Us Weekly magazine is running a clock, ticking off the days (84 and counting) since Suri's birth.   German TV station RTL, taking matters into its own hands, has produced a composite image of what Suri might look like.   TMZ.com, perhaps digging for evidence of Suri's existence, obtained a copy of the official birth certificate, filed May 8 in Los Angeles.  And gossip Web site Defamer.com has called the delay ‘profoundly strange’ and upgraded its suspicion from ‘mystery’ to ‘riddle that would make the Sphinx incontinent.’”

Our founding fathers knew strong, vigorous reporting would serve America best.

HOW DARE YOU?

“We live in a democracy.  The job of elected officials is to listen to constituents, evaluate issues and – where they believe it is appropriate to do so – take official action on a matter.”

“Plaintiffs want this Court to punish Commissioners Shellenberger and Henderson with a ‘gag order’ for having engaged in the first two steps of their job – a punishment that is inconsistent with an operating democracy…”

“Defendant’s Brief Opposing Motions for a Preliminary Injuction” (click here).

The Lancaster Newspapers, as a partner in the Penn Square Partners, have filed a lawsuit to “gag” the elected County Commissioners from communicating or taking any actions that are adverse to the proposed, publicly funded, hotel and convention center project in which they have a huge vested interest.

It is impossible for me to find words to express my outrage and absolute disgust.

Please read the above brief and attend tomorrow’s hearing at 9:00 a.m. in Courtroom 2.
