This email in regarding the jury’s verdict in the Micah Stewart trial:“How on earth could it be anything other than all or nothing?”
I am going to take a break today to ponder some things.I’m going to think about the power the prosecution brings into a trial. I’m going to think about the power of the police and the District Attorney.I’m going to think about the power of judges.I’m going to think about defense attorneys.I’m going to think about juries.I’m going to think about 21 bullet holes and three shell casings.I’m going to think about the power of the news media. I’m going to think about how terrible this morning’s Intell article, “Stewart found guilty of attempted murder” is (click here).It is not factual.
To sum it up, I’m going to think about justice and equality.I’ll have a look at all of these things through the lens of the Stewart case this weekend.

“NOT FAIR TO THE DEFENDANT”
“It makes no sense,” attorney Roger Renteria said by phone this morning regarding the verdict in Micah Stewart’s attempted homicide trial.Stewart was charged with three counts of attempted homicide after allegedly shooting at three individuals on the night of March 30, 2005 in Columbia.The jury found Stewart not guilty on two of the counts and guilty on one.
“It doesn’t make sense,” Renteria said repeatedly.“It’s sad,” Renteria said.“It doesn’t match the facts.It was a compromise.The jury wanted to go home.That is not fair to the defendant.”
Renteria said there will most likely be an appeal.He said, “Micah Stewart cannot get a fair trial in LancasterCounty.”
There will be more later today.
“I find it hard to believe that two different people had bullet holes in their clothes but not one scratch on either of their bodies. Something is not right with this!”

The jury in Micah Stewart’s trial found him guilty of one count of attempted homicide and three counts of aggravated assault.Jay Whittington, partner with Roger Renteria, Stewart’s attorney, said, “We’re happy the jury listened to our argument.But their decision (of one count of attempted homicide – Stewart was charged with three) is clearly confusing and seems logically inconsistent.”

The Stewart jury asked the judge this morning for the meaning of a “hung jury.”The jury came back before lunch and told Judge Madenspacher that they would not be able to come to agreement on the attempted homicide charges.The Judge told them to eat lunch and think about it.Court is scheduled to reconvene at today.
Regarding yesterday’s testimony, some things are so far-fetched they almost make sense - until you stop and think about them.Pennsylvania State Trooper Todd Neumyer needs to demonstrate to the public how a total of 21 bullet holes can be made in five separate pieces of clothing by one bullet.Or three bullets.Or five bullets.Or 10 bullets, for that matter.
“Baggy” doesn’t explain it.“Creases” don’t explain it.My son has dressed the way these boys were dressed for years.He wears a 4X T-shirt.There are no creases.The idea is for the T-shirt to go as low as possible.Yes, his pants hang off his butt but where could a bullet go through without hitting his body?Where are there creases?At the ankles, where the pants that are worn low “bag” up.That’s the only place.
As noted yesterday, the New Era said of Neumyer’s testimony, “He also testified that all 21 holes could have been made by between one and three bullets.”Prove it, Trooper Neumyer.Demonstrate for us how that could occur.
Speaking of T-shirts, regarding Harry Eng’s “explanation” of his arrest and conviction on www.5thestate.com, a Talkbacker and friend sent out an email with the following T-shirt suggestions - “Snow” White, “Dirty Harry,”“Smack” Towers, COKE This! BLOW N’ ENG and WHITE BOYS “BLOW.”
She said, “Dear Lancaster folks.You are so naïve!!!We call it ‘money laundering’ down here.What was the street value of the 69 pounds of coke?It was $1 million, three hundred thousand dollars!But the newspaper said they were moving 200 pounds a month through his private yacht cruise ship!That comes to $45 million.I just see him as ‘Dirty Harry’… you play… at times you lose!”

I understand.And my parents repeatedly said that I was crazy to try and explain the whole thing away.At 47 years-old their daughter just went crazy.No, I didn’t.Because what I discovered was a family tragedy of such huge proportion, they cannot explain it away. This is why these stories have to be told.This is why the public has to be educated on the effects of incest and sexual abuse.This is why, as a society, we must work stop it.
At least Hatcher got to help to put her abuser in jail.If I could, I would have my father and mother arrested and tried today.That’s how awful it is.

This email in from a court observer of the Micah Stewart trial for attempted homicide regarding yesterday’s testimony, “The prosecution made most of their case today and Roger [Roger Renteria, Stewart’s attorney] made a liar out of them all.”
I simply can not get away to cover this trial.It is killing me, but that is life.As I stated here before, trials are the most interesting, surprising and the highest form of human drama you will ever see.Justin Quinn’s reporting gives you absolutely no feel for the courtroom and the atmosphere.He doesn’t say how many observers where in the room or who they were.He gives you no sense of suspense or drama or who is “winning” or “losing.”
The information in his article, “Stewart beaten months before shooting,” (click here) is not new.Stewart’s mother posted the following on the LOL Talkback Board on May 11, 2005 under the thread for the article, “F&M coach’s son cleared in shooting.” (Clickhere.Please note I have corrected some spelling and added spacing.People who post are not attempting to use “perfect” spelling and grammar, and the items I changed do not effect the intended meaning):
“Eight months ago, my son was brutally assaulted in his home when four guys forced their way into his father’s place of residence. He had to be taken by ambulance to the hospital. He had broken bones and contusions so bad they ran tests for a concussion. They also assaulted his father and did thousands of damage to the property.The only charges they received from Columbia Police were trespassing. They should have been put in jail. Three weeks later, the same group of guys caught my son on the street and assaulted him again. His eye was blackened and swollen shut. He managed to escape this time because he was out in the open. About five weeks ago the same group of guys, plus a young girl, go to his father’s place, where my son resides, to assault him again.This time my son comes outside with a gun to scare the one guy that was there. Two other guys jump out from around the corner.Again they were going there to assault him. My son took two shots. He's now being charged with three counts of attempted murder, $750,000 bail.
The District Attorney sent out about twenty men with body armor, helmets, rifles and the whole nine yards. There are a lot of witnesses to all of these events.My son is in jail because his name is Micah Stewart. He can't depend on the Columbia Police for protection, there's too much corruption. When the police won't protect you and you’re being stalked, you eventually resort to anything to protect yourself! We know why the coach’s son wasn't charged, and so does the D.A.”
There will be much more tomorrow.One note – the thread is interesting for many reasons and, yes, that is me posting as “Becky.”If you go to page two of the Talkback, I have one of my favorite lines, “I didn’t take an AK-47 to college.Did you?”I will look at the Glenn Robinson “non-case” at a later date.
What tangled webs we weave.Stewart, Harper, the Coroner, the DA and many other items will come tomorrow along with an answer to the burning question - how long is Roger Renteria’s hair?Wow!
