I placed two phone calls to Kevin Harley in the State Attorney General’s Press Office today regarding their investigation into Lancaster County Coroner Dr. G. Gary Kirchner.He has not returned my calls. If I have not heard back from him by the end of the day tomorrow, I will file a complaint with the State Attorney General and the Governor.
Another strange twist in this investigation of Kirchner for “leaks” in the Cortney Fry case is that he was not the coroner who did the autopsy.Her autopsy was conducted by Lancaster County Forensic Pathologist Dr. Wayne Ross.Please click here to read Lancaster County District Attorney Donald Totaro’s own press release regarding the filing of homicide charges against Micah Stewart.Please also note that Ross determined her cause of death to be “Multiple Traumatic Injuries including Suffocation,” according to Totaro.
Today I am reprinting Dr. Ross’s testimony from Micah Stewart’s Preliminary Hearing on August 8, 2005 (click here for the page on this site where it is archived with other preliminary hearing testimony).Please note I headlined this “Crucial Testimony” at the time.Dr. Ross testified that he changed his initial report after Detective Geesey requested he review witness statements and amend the cause of death to fall in line with those statements.The District Attorney’s Office, and possibly Ross, need to be investigated for misconduct in this case.So why is Kirchner being investigated?

~ Crucial Testimony ~
What appears below is extremely crucial testimony from Dr. Wayne Ross in the preliminary hearing for Micah Stewart.The exchanges are accurate to the best of my ability.I will request the transcript and publish that at a later date.There seemed to be some “confusion” or “misuse” of the words “strangulation” and “suffocation” by Ross.A very brief description of the hyoid bone is here.Again, Ross testified that the hyoid bone was not present in Fry’s remains.
The fourth witness to take the stand was Dr. Wayne Kenneth Ross.He testified that he is a forensic pathologist and has worked here for over 10 years.Hackman asked Ross if on January 24th of this year he performed an autopsy.Ross said yes at Conestoga View.Hackman showed him the same four photographs he showed Detective Eelman.Ross testified the one photo depicted the remains in the morgue.He said he did not go to the scene [where the body was found].
Hackman asked who made the identification that this was Cortney Fry.Ross said, “Dr. Bender.”Hackman asked if the remains had been sent to a forensic anthropologist.Ross said “yes – to Mercy Hurst.”Hackman asked if they had determined a manner of death.Ross said yes, their report indicated “multiple traumatic injuries.”Ross said it was a “homicide.”
Renteria crossed.He asked again where the autopsy had been performed.Ross said Conestoga View.Renteria asked if Detective Geesey [Lancaster County Detective Joseph Geesey] was present during the autopsy.Ross said no.Renteria asked Ross if the cause of death was multiple traumatic injuries.Ross said, “correct.”Renteria ended.
Hackman returned.He asked Ross if there were other causes of death.Ross said, “suffocation and strangulation” were the cause of death.He said he had received a request from Detective Geesey to review the witness statements.He said he reviewed the witness statements.Ross stated that there was clear evidence of suffocation.
Renteria re-crossed.He asked Ross if that had been in his initial report.Ross said, “No.”He said he finally amended his report to bring it “in line after the police asked me to look at it in a new light after reviewing the witness statements.”Renteria asked him what elements might make up “multiple traumatic injuries.”Ross said, “suffocation and strangulation.”He said his report indicates “multiple elements of suffocation.”Renteria asked if this was his amended report.Ross said,” yes” and that it was consistent with the witness statements.
Renteria asked him what about the remains indicated suffocation.Ross talked about the hyoid bone which he described as a v-shaped bone under the jaw.He said the bone is an excellent indicator of strangulation.Renteria asked him if the bone was present in Fry’s remains.Ross said, “No, the hyoid bone was not present.”

Dr. G. Gary Kirchner is currently the acting coroner for LancasterCounty according to the woman who answered the phone in the coroner’s office at today.When asked if he is the subject of an investigation by the State Attorney General’s Office she said, “I can not comment on that.”

The silence on this issue by the Lancaster Newspapers is inexcusable.It is inexcusable. On Monday afternoon, February 14, 2005 I placed a call to the Pennsylvania State Attorney General’s office.It was returned by a Jim Gallagher the next morning at (717-787-6858).I explained that there was an unsolved murder case in Lancaster that the Lancaster Detectives seemed to need help with.He seemed quite interested that I had a website and said he needed to let his superiors know that I made the call and they needed to review my website.
I placed at least one follow up call every business day that week.On Friday I asked to speak to his supervisor and was told he was the supervisor. I asked for his title and was told he is the Supervisory Special Agent in the Criminal Division of the State Attorney General’s Office.Yesterday, I placed yet another call.It was returned the same day by Kevin Harley of the Attorney General’s Press Office (717-787-5211).He basically said there is nothing they can do.
I will relay his exact comments this weekend in a full story on the case.In the meantime I continue to make calls and pursue the matter and will post names and phone numbers on this site.
The lead story in this morning’s Intell was “Gambling crackdown – DA’s office leads raid on five county businesses, detectives seize 21 illegal gaming machines.”The article reports this was the result of an “eight-week investigation” by the Lancaster County Detectives.
I was in Lancaster two weeks ago for less than 36 hours and I know where a machine is and it’s not one of the locations listed.Yes, the “Eagles” jacket you can win is hanging right behind the machine.
Perhaps the Lancaster County Detectives should devote more time to arresting the killer of a 19 year-old mother of a two week-old baby.There’s a killer on the loose and they are making headlines for seizing 21 “illegal gaming machines.”
From the absurd to the twilight zone
I spoke on the phone Thursday, February 11 , with Chief County Detective Michael Landis who is in charge of the murder investigation of Cortney Fry.He stated that there are four detectives working full time on this case.He also stated that Micah Stewart, her boyfriend who is in jail on unrelated charges, has not been questioned once since her body was found.This is simply an outrage and the detective “work” in this case has gone from the absurd into the twilight zone.Everyone in LancasterCounty should demand answers in this case.Every detective working on this case and the District Attorney, Donald Totaro, need to be held accountable.
The memorial service for Cortney Fry is this Sunday from to at the Columbia Presbyterian Church, 360 Locust Street in Columbia.Coming this week, this website will request outside help in obtaining an arrest of the murderer of a nineteen-year old woman who was the mother of a two-week old baby.

As many readers of this website know, I’ve had a box at the top of this website for almost six months.When I took it down yesterday, I had changed it that morning to read “It’s been one-hundred and seventy days since the coroner released his autopsy on Cortney Fry.”I do not have time today to discuss the charge of murder brought against her boyfriend, Micah Stewart, yesterday.I will do a lengthy story next week, which will also be the one year anniversary of the day she “disappeared” (July 20, 2004).What I will say today, and expand upon in my article, is that an outside agency needs to come in and investigate the District Attorney’s office and their investigation of this case.An alleged murderer was left on the streets for almost a year.A family was in anguish.Donald Totaro, and the CountyDetectives that were involved in the case, need to be removed and possibly prosecuted.More later.

There seems to be a problem solving crimes in LancasterCounty.An investigating grand jury was empanelled in 1995, again in 2001, and now Lancaster District Attorney, Donald Totaro, has announced yet another.This requires 23 jurors and 10 alternates and costs the citizens of this county a huge amount of money and time.
Interestingly, Totaro is quoted in the New Era article, "Target:unsolved mysteries" on March 15, 2005, saying that he asked President Judge Louis J. Farina's permission to convene the jury in February.That is the same time I was placing phone calls to the State Attorney General's office to get help with this brutal crime the Lancaster County Detectives obviously did not want or plan to solve.
I placed those calls shortly after a phone interview with Chief County Detective Michael Landis on February 11, 2005.In that interview he said the detectives had not questioned Micah Stewart, Cortney Fry's boyfriend, since her body was found well over two weeks before on January 22, 2005.
Now Totaro wants to convene an investigative grand jury to interview "witnesses" when his office made no attempt to interview the primary suspect and last known person to see her alive for over two weeks after her body was found and identified.
Why hasn't he asked for help if his detectives can't get this killer off the streets?Why hasn't he gone to the State Attorney General and asked for help?Why hasn't he asked other law enforcement agencies to come in and review the evidence to see if his detectives are missing something?
This grand jury is nothing but a blatant attempt to keep this case hushed up and to keep the media and other interested parties away.Not one detail of the autopsy has been released.The LancasterCounty detectives have made no attempt to solve this crime.And now the DA wants to convene an investigative grand jury to keep it hushed up.This is corruption at the highest level.There is a killer on the loose.Demand answers in the Cortney Fry murder now.

I do not have time to go into detail on District Attorney Donald Totaro today. This website has covered some of his activities for over a year and I will begin detailing those next week.It is “ironic” that the supposed leaks involved the Cortney Fry case (please see the report onwww.5thestate.com).In February of 2005, as documented on my website, I called the State Attorney General’s Office several times and asked them to investigate this case and the way it was being handled by the District Attorney’s office.Two weeks later, Totaro announced the convening of a grand jury.That way he could keep the state out and keep things the way he likes them – hush, hush.When people want things kept quiet there’s a reason.This absurd investigation into Lancaster County Coroner Dr. G. Gary Kirchner is going to backfire in Totaro’s face.With both the Fry case and the David Ludwig case, Totaro has at least one very major problem, namely, Lancaster County Detective Joseph P. Geesey.Totaro’s days are numbered.

For most of this last week I had “fun” with the pathetic state of the Sunday News (please see the stories directly below).Marv Adam’s column is so genuinely bad they do not even post it on line.This week he has the unmitigated gall to say, “Despite the bad press (never thought I would write that) for the industry, newspapers are strong, still the source of most of the information you receive and (trust me) the most trustworthy.”Why would I trust you, Marv?This week the only news story in your whole paper is taken directly from the 5thestate website (click here for the Sunday News article).And the story involved your own company’s newspaper reporters and there was not a word about this in the Lancaster Newspapers?And you want us to trust you?
I could list 15 reasons in less than a minute why people shouldn’t trust your papers and one of those would be your coverage, or lack thereof, of the Cortney Fry case, the grand jury that was convened and her accused killer being left on the street for a year during which time he was charged with three counts of attempted homicide.Your papers are a disgrace.And if you think people are going to pay $1.75 a week to get “Gil Smart’s exclusive column” you literally need to have your head examined.And I certainly wouldn’t pay $1.75 to read about a stupid sports headline you wrote in 1995, for God’s sake, or to get two Sudoku puzzles.
